El Departamento de Trabajo de EE. UU. emiti\u00f3 el 17 de septiembre de 2013, normas revisadas dentro de la Ley de Normas Justas de Trabajo (FLSA) que impactan a los empleadores de cuidadores de ancianos y que entrar\u00e1n en vigor el 1 de enero de 2015. Una revisi\u00f3n clave es la definici\u00f3n de lo que constituye cuidado de compa\u00f1\u00eda.<\/strong>.<\/a><\/p><\/blockquote>\n

\u00bfPor qu\u00e9 es importante definir la \u2018atenci\u00f3n de compa\u00f1\u00eda\u2019?<\/strong><\/span><\/h2>\n

 <\/p>\n

\"reglasHoy, todo<\/span> Los cuidadores de adultos mayores que brindan cuidados de compa\u00f1\u00eda en el hogar particular de una persona con discapacidades o de la tercera edad est\u00e1n exentos de las protecciones salariales m\u00ednimas y de horas extras de la FLSA, y se definen como proveedores de \u201cservicios de cuidados de compa\u00f1\u00eda\u201d. Las tareas y deberes que constituyen los cuidados de compa\u00f1\u00eda hoy en d\u00eda son m\u00e1s bien amplias, y las reglas que entran en vigor en enero de 2015 reducen significativamente las definiciones de tareas y deberes. Si bien algunos acompa\u00f1antes empleados de forma privada seguir\u00e1n encajando en la designaci\u00f3n de cuidadores de compa\u00f1\u00eda, las nuevas reglas no permitir\u00e1n que los cuidadores empleados por agencias sean clasificados como acompa\u00f1antes, punto.<\/p>\n

Las cuidadoras empleadas por agencias estar\u00e1n cubiertas por las protecciones del salario m\u00ednimo y horas extras de la FLSA. Las cuidadoras empleadas por agencias no podr\u00e1n ser clasificadas como acompa\u00f1antes para el cumplimiento de salarios y horas. Solo las cuidadoras de mayores empleadas de forma privada que presten servicios de cuidado de compa\u00f1\u00eda de buena fe podr\u00e1n calificar para esta exenci\u00f3n.<\/p>\n<\/blockquote>\n

Entonces, \u00bfexactamente c\u00f3mo se diferencia la definici\u00f3n actual de servicios de compa\u00f1\u00eda de las nuevas reglas?<\/strong><\/span><\/h2>\n

La tabla siguiente ilustra las tareas comunes de un cuidador de personas mayores que trabaja en el sector privado. Este cuadro clasifica las tareas en: cuidados de compa\u00f1\u00eda (\u221a), tareas incidentales permitidas que no pueden exceder el 20% del tiempo del cuidador (20%) y aquellas que est\u00e1n excluidas (EXCLUIDAS); adem\u00e1s, indica que, cuando sea necesario, el cuidador no puede ser clasificado como acompa\u00f1ante.<\/p>\n

\"CompanionshipCare2015\"Conclusi\u00f3n:<\/strong><\/span><\/p>\n

Actualmente, los cuidadores de personas mayores que trabajan en el sector privado pueden prestar algunos servicios generales de limpieza a sus empleadores, siempre y cuando el tiempo dedicado a las tareas dom\u00e9sticas no alcance ni supere el 20% de su tiempo total de trabajo, y sigan estando exentos de las protecciones relacionadas con el salario m\u00ednimo y las horas extras. A esto se le conoce como la \u201cexenci\u00f3n por compa\u00f1\u00eda\u201d.\u201d<\/p>\n

A partir de enero de 2015, un cuidador de personas mayores contratado de manera privada que preste CUALQUIER servicio de limpieza general no podr\u00e1 acogerse a la exenci\u00f3n por compa\u00f1\u00eda, por muy incidental que sea. Adem\u00e1s, un cuidador de personas mayores contratado de manera privada que preste servicios de cuidado personal no podr\u00e1 acogerse a la exenci\u00f3n por compa\u00f1\u00eda si el tiempo dedicado a estos servicios alcanza o supera el 20% de su tiempo total de trabajo. Estos cuidadores ser\u00e1n considerados empleados de servicios dom\u00e9sticos y estar\u00e1n sujetos a las normas aplicables en materia de horas extras y salario m\u00ednimo.<\/p>\n

La exenci\u00f3n de compa\u00f1erismo se limita estrictamente a los servicios definidos como compa\u00f1\u00eda y protecci\u00f3n, permiti\u00e9ndose solo servicios de cuidado personal incidentales.<\/p>\n
